General Terms and Conditions and Customer Information

2. Scope

These General Terms and Conditions apply to all orders concluded via the VYRD.art online shop. The offer is directed at both consumers and business customers; the right of withdrawal under Section 10 is available to consumers only.

3. Products

VYRD.art offers original paintings, objects, sculptures, photographs, fine art prints, editions, artboxes and curated single pieces. Details of technique, dimensions, presentation, scope of delivery, edition and the character of the work are set out in the respective product description.

Individual works may contain older, used, patinated or deliberately aged components, such as frames, albums, supports, objects or mountings. Where such components form part of the respective work, this is stated separately in the product description; in that case they belong to the artistic execution of the work offered.

4. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the order button, you submit a binding offer to purchase the goods contained in the shopping cart. We confirm receipt of your order immediately and automatically by e-mail. This acknowledgement of receipt does not yet constitute acceptance of your offer.

The contract is only concluded when we declare acceptance separately (order confirmation) or ship the goods or make them ready for collection. As many of the works are single pieces, we reserve the right not to accept an offer if the work in question is no longer available in the meantime. In that case, any payments already made will be refunded without undue delay.

5. Prices and shipping costs

All prices are final prices. As a small business within the meaning of § 19 UStG (German VAT Act), we do not show VAT. Any additional shipping costs are stated separately in the respective offer or, at the latest, during the order process before the order is placed.

6. Payment

The available payment methods are displayed during the order process. These include, in particular, Shopify Payments, PayPal and bank transfer / prepayment. For payment by bank transfer / prepayment, the goods are shipped, made ready for collection or prepared for an agreed handover once payment has been received.

7. Delivery and collection

Shipping is currently within Germany. Shipping within the EU will be added shortly; deliveries outside the EU are available on request only for the time being. Collection in Stuttgart-West is possible by arrangement.

For larger works, personal delivery is possible by arrangement, particularly in Baden-Württemberg and in parts of Hesse, Rhineland-Palatinate and Bavaria; it is made against a delivery cost contribution agreed in advance. For larger, delicate or particularly valuable works, the shipping method and handling can be arranged individually prior to shipping.

8. Delivery times

The applicable delivery time is stated in the product offer or during the order process. For unique works, framed pieces, objects or larger works, the delivery time may be extended by packaging, coordination or personal handover.

9. Retention of title

The goods remain the property of conic new media, owner Stefan Rienth, until payment has been made in full.

10. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. The details, including the option of exercising it via our electronic withdrawal function, are set out in the separate instructions on withdrawal. The direct cost of returning the goods is borne by the buyer.

11. Returning delicate works

Many works at VYRD are single pieces, framed objects or delicate originals that can be damaged in transit more easily than ordinary merchandise. We therefore ask for careful packaging (in the original condition where possible, otherwise of equivalent strength and transport safety) and recommend trackable and adequately insured shipping for high-value works. This notice is a voluntary service and does not restrict the statutory right of withdrawal.

12. Warranty

The statutory warranty rights apply. For works containing older, used, patinated or deliberately aged components, the details in the respective product description apply in addition; where such properties are described there as part of the character of the work, they belong to the contractually agreed condition of the work.

13. Authenticity and certificates

Where stated in the product description, a certificate of authenticity is included. For limited editions, the edition size and the individual number are stated in the product description or on the certificate.

14. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Contract text, input correction and contract language

The contract text is stored by us; the terms applicable to your order are sent to you in text form with the order confirmation. Before submitting your order with binding effect, you can review your entries in the order summary and correct them at any time using the usual keyboard and mouse functions and the editing functions of the shopping cart. The language available for the conclusion of the contract is German.
